These Terms apply to orders placed by consumers. Sales to business customers may be subject to separate terms.
ARTICLE 2 - PRODUCTS
The essential characteristics of the products are set out on the product pages. Photographs and images are provided for illustrative purposes. Noungolf strives to ensure their accuracy, but slight differences in appearance, particularly in colour depending on the screen, may occur.
ARTICLE 3 - PRICES
The applicable prices are those displayed when the order is placed, in the currency and under the tax regime shown on the website [À CONFIRMER : TTC, ou mention applicable si la TVA n'est pas applicable]. Delivery charges and, where applicable, information on taxes or import costs are displayed before the order is finally confirmed.
For destinations outside the European Union, duties, import taxes or customs clearance fees may be charged by local authorities or intermediaries where they are not included in the price paid to Noungolf.
ARTICLE 4 - ORDERS
The customer selects the products, checks the basket, provides the requested information, chooses the delivery and payment methods, then reviews the summary before confirming the order. The customer may correct any errors before final confirmation and accepts these Terms before confirming the order.
The order becomes final once payment has been validated and Noungolf has confirmed it by email, subject to legitimate grounds for refusal provided for by the regulations, including suspected fraud, payment incidents or exceptional unavailability.
ARTICLE 5 - PAYMENT
The payment methods offered include PayPal, the compatible bank cards displayed at checkout, Revolut Pay, Apple Pay and Google Pay. The methods actually available may vary by country, device or browser and are displayed before the order is confirmed.
Full card details are processed by the payment providers and are not retained by Noungolf.
ARTICLE 6 - DELIVERY
Noungolf offers worldwide delivery, subject to legal, customs, logistical or technical restrictions applicable to certain destinations. The available delivery methods, costs and times are displayed before the order is confirmed.
Where the seller has not indicated a delivery date or period, delivery will take place no later than the applicable statutory period. Consumers' rights in the event of late delivery remain fully applicable.
ARTICLE 7 - PASSING OF RISK
For sales to consumers, the risk of loss or damage passes when the consumer, or a third party designated by the consumer other than the carrier offered by Noungolf, takes physical possession of the goods, subject to the specific rules that apply where the consumer chooses a carrier not offered by Noungolf.
ARTICLE 8 - STATUTORY RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract within 14 days without giving any reason, subject to the exceptions provided for by law.
The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier and designated by you, take physical possession of the goods.
Where several goods ordered in a single order are delivered separately, the period expires 14 days after the day on which you, or a third party other than the carrier and designated by you, take physical possession of the last item. Where goods are delivered in several lots or pieces, the period expires 14 days after physical possession of the last lot or piece is taken.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unambiguous statement (for example, a letter sent by post or an email) addressed to: [À CONFIRMER : Prénom NOM], EI, Noungolf Pro Junior, 38 avenue Reberteau, 60260 Lamorlaye, France; telephone: [À CONFIRMER]; email: contact@noungolf.com.
You may use the model withdrawal form set out in the appendix, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
ARTICLE 9 - RETURNS AFTER WITHDRAWAL
You must send back or hand over the goods to [À CONFIRMER : nom et adresse de retour] without undue delay and, in any event, no later than 14 days after the day on which you inform us of your decision to withdraw from this contract. This deadline is met if you send back the goods before the 14-day period has expired.
You will bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
ARTICLE 10 - REFUND AFTER WITHDRAWAL
If you withdraw from this contract, we will reimburse all payments received from you, including delivery charges (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us), without undue delay and, in any event, no later than 14 days after the day on which we are informed of your decision to withdraw from this contract.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods or until you have supplied proof of having sent them back, whichever occurs first.
ARTICLE 11 - 30-DAY COMMERCIAL RETURN POLICY
In addition to the statutory right of withdrawal, Noungolf grants its consumer customers a commercial right to return products up to thirty (30) days after receipt, provided that the products have not been worn beyond simple fitting, have not been washed or damaged, are complete and, where possible, are accompanied by their labels and accessories.
This commercial benefit neither limits nor replaces consumers' statutory rights. Unless otherwise offered, return costs under this commercial policy are borne by the customer.
ARTICLE 12 - EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The right of withdrawal does not apply in the cases provided for by law, including, where relevant to the Noungolf offer, goods made to the consumer's specifications or clearly personalised. Any applicable exception is indicated before the order is placed.
ARTICLE 13 - STATUTORY WARRANTIES
The products sold benefit from the statutory warranty of conformity and the statutory warranty against hidden defects. The box below forms an integral part of these Terms.
The consumer has two years from delivery of the goods to obtain the implementation of the statutory warranty of conformity if a lack of conformity appears. During this period, the consumer need only establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract of sale provides for the continuous supply of digital content or a digital service for more than two years, the statutory warranty applies to that digital content or digital service throughout the agreed supply period. During this period, the consumer need only establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The statutory warranty of conformity requires the professional, where applicable, to provide all updates necessary to keep the goods in conformity.
The statutory warranty of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience to the consumer.
If the goods are repaired under the statutory warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer requests repair but the seller imposes replacement, the statutory warranty of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price while keeping the goods, or end the contract and obtain a full refund in return for giving back the goods, if:
1. The professional refuses to repair or replace the goods;
2. The repair or replacement takes place after a period of thirty days;
3. The repair or replacement causes major inconvenience to the consumer, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4. The lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. In that case, the consumer is not required to request repair or replacement first.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining warranty period until the repaired goods are delivered.
The above rights result from Articles L. 217-1 to L. 217-32 of the French Consumer Code.
A seller who obstructs the implementation of the statutory warranty of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).
The consumer also benefits from the statutory warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code for two years from discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept, or to a full refund in return for giving back the goods.
ARTICLE 14 - IMPLEMENTING THE WARRANTIES
For any request, the customer may contact contact@noungolf.com or write to the address given in Article 1, stating the order number, the product concerned and the nature of the problem. Photographs may be requested where useful for diagnosis, without depriving the consumer of their rights.
ARTICLE 15 - LIABILITY
Noungolf is liable for the proper performance of its obligations under the conditions provided for by law. No clause of these Terms is intended to, or has the effect of, excluding or limiting a mandatory right granted to the consumer.
ARTICLE 16 - FORCE MAJEURE
Neither party may be held liable for a failure resulting from a force majeure event within the meaning of applicable law, without prejudice to the consumer's mandatory rights.

The processing of personal data is described in our Privacy Policy. The rules on trackers are set out in our Cookie Policy.
